Sarnam.com provide its services subject to the following Terms of Service (TOS), which may be amended from time to time, without prior notice.

Our Service:

Sarnam.com is intended to provide various services and product related to Astrology.

All orders are accepted on the understanding that you have agreed to the following terms and conditions. Orders must be paid for in full in advance. Each reading is prepared individually and is not a fixed product, so the quantity of information and length of reports can vary according to the findings of each person's chart. Astrology prediction can never provide certainties. Life is a series of choices, you choose what you do with your life. You, those around you and your environment are in constant change, nothing is guaranteed.

Sarnam prepares every reading in good faith as the best guide to events as Sarnam sees them based on the information you give. Sarnam is always keen to hear from clients as to how things turn out, but can accept no responsibility if things do not go as predicted.

Due to the demand for Sarnam's dedicated service at times a waiting list builds up, delivery for readings is usually around 10 days from the date of order, if it is likely to be any other you will be informed.

It is your responsibility to give accurate information when placing your order. The birth details you enter on the order form will be taken as being correct. If you do not know your birth details please contact us before placing your order.

Complaints Procedure:

Although Sarnam is confident that you will be pleased with the work carried out on your behalf, there may be an occasion when mis-understandings or errors occur. In this event Sarnam will endeavour to resolve the matter in your best interest. Please contact Sarnam without delay if you have any problem with readings supplied.

ACCEPTANCE OF Sarnam ASTROLOGY TERMS:

When using Sarnam.com's astrology services, You ("member" or "you" or "your") agree to the terms and conditions described herein ("terms of service"). By clicking on the [Buy it ] button, you are agreeing to use the Service in a manner consistent with the terms and conditions of this Agreement and with all applicable laws and regulations.

DESCRIPTION OF ASTROLOGY SERVICES:

 Sarnam.com provides astrological content, reports, and data ("Content") via the World Wide Web and electronic mail. Astrological content shall be provided to you in readable format. Although portions of the Content may be viewed by visiting the Sarnam.com site, in order to access the personalized astrological product/s from Sarnam.com, you need to register and purchase the product. For the Personalized Services, Member agrees to provide certain current, complete, and accurate information about Member as prompted to do so by Sarnam.com. All information that We request and You provide on sign-up are referred to in these Terms of Service as "Registration Data."

PAYMENT:

Upon placing an order for personalized astrological product/s, you hereby authorize us to charge your credit card account in advance, for the full price of the product/s opted for. While Sarnam shall make every attempt to provide you the product/s upon realization of your payment, you understand and agree that due to technical or other reasons, it may not be possible for Sarnam to provide you with the product/s even after receipt of your payment. In such an event, you will be entitled only to a refund of your payment.

You acknowledge and agree that Sarnam reserves the right in its sole discretion, to change the Fee Schedule(s) at any time during the currency of this service. Any such change in the Fee Schedule(s) shall be applicable only to any of your future charges.

Notwithstanding anything to the contrary herein, in no event will you be entitled to a refund of any portion of the product purchase amount due to any non-usage or otherwise.

1).Dakshina / Donation is by choice and not by any compulsion this point can't be raised in any court of law in any country.No dispute can be raised regarding quality / quantity/authenticity of any items or any loss / gain in mental / physical /economical etc. due to our puja items /tantric items/astrology/gemstone/jewel articles/services etc. related items/gemstones /yantra items or services etc.

2).Pricing & availability should be confirmed of those items whose prices are not specified or those items / service which are not in our product / service menu, and accordingly  payment is made.No gaurantee of the product/services are offered and no claim can be made.No complain in this regard can be lodged in any country.

 3).Global Delivery all items are sent preferably by Indian Govt. Postal Services, Registered  Post/ Registered Parcel / Speed Post or by leading Courier Companies. It may reach overseas  location within two weeks time or little more,depending upon location, once delivered or any delay in delivery of any such product must be reported immediately.We are not responsible for any delay f the Postal/courier Services etc.

4).One should first confirm the availability,pricing,specification,quality etc. of the given/shown items/services,before placing any order.As order once placed can not be cancelled/exchanged in any case and no refund of the amount can be made.We do not have any kind of return policy of our products/services.

5).Our prices are very competitive,nevertheless no comparision can be made with other websites,and we also have right to change the prices of our services/products with out any prior notice.

6).Sarnam.com is not responsible for any kind of side effects or negative effects of any of our services or products or gemstones,as it is solely discretion of the customer to use or utilise the product or services.Similarly any Puja or Spiritual ritual/advice may or may not provide the desired results,we will not be responsible in any way, for not yielding the results.

Our Preferred Postal & Courier Services:

Most of the items orderd are sent by Govt. of India,Postal Services,Registered Post or Speed Post,it reaches in around two to three weeks time,in case of Registered Post and in around one week time in case of Speed Post .The ordered items are sent,as per the shipping address,provided by the customer,if any  wrong shipping address is provided by the customer,then we will not be responsible for non-collection of the tem,similarly if the concerned person is not available to collect the sent shimpent,then also we will not be responsible for this and no duplicate items will be sent again.In some countries,mostly in South America and Africa,it is found that postal authorties are not prompt,and due to their negligence,i.e Postal Services negligence,if the sent item is not received,then also we will not be responsible.

Mail regarding shipment of the ordered item is immediately sent,and it is expected that customer will reply,as soon as the item is collected at their end.

   

7).Items/Services/Products once purchased will not be Returned/Exchanged in any case and no refund of money will be made.Customers are requested to order their products/services only after due consultation,and all queries,if any, must be asked before the purchase. We do not have any kind of return policy.If customer has any doubt regarding to quality/quantity/authenticity of any product/services,that must be asked before the item is ordered.This term is applicable to all of our orders.

8).All given prices are in U.S. Dollors,with a constant exchange rate of 49 to an Indian Rupee,i.e. One U.S. Dollor is Rs.49/- Indian Rupees.It will not change,unless big fluctuation in the exchange rate, to U.S. Dollor and Indian Rupee, take place.This exchange rate also includes service taxes,comission charges and shipping charges.Presently one Dollor is around Rs.49.38/- Indian Rupee,as on 22 Oct. 2008.

9).Many Spiritual/Puja/Tantric items etc. are provided by our vendors,who put their items for sale on our site,we will not be responsible in any ways,for their flaws etc.

10).All pictures shown on the site for Products/Services are suggestive,actual service/item/picture etc. may differ from the shown pictures.

11).Sarnam.com may revise/enforce new terms,from time to time,without any prior notice.

PRIVACY Policy:

Sarnam will not monitor, edit, or disclose the contents of your astrological product/s, except that User agrees Sarnam may do so: (a) as required by law; (b) to comply with legal process; (c) if necessary to enforce Sarnam.com Terms and Conditions; (d) to respond to claims that such contents violate the rights of third parties; (e) to protect the rights or property of Sarnam or others; and (f) to identify or resolve technical problems or respond to complaints about the product.

PERSONAL USE AND SECURITY:

You acknowledge your right to use the Service is personal to you. You are entirely responsible for not maintaining the confidentiality of your password and account. You shall be fully liable for all use of your account, including any unauthorized use of your account by any third-party. During the existence of your astrological subscription service

PROPRIETARY RIGHTS TO CONTENT:

You acknowledge that Content, including but not limited to text, software, photographs, graphics or other material contained in either sponsor advertisements or distributed via email, commercially produced information presented to You by Sarnam.com, its suppliers, and/or advertisers, is protected by copyrights, trademarks, service marks, shall at all point of time be and remain the property of Sarnam.

You are only permitted to copy, use, reproduce and distribute the Content as expressly authorized by Sarnam.com, its suppliers.

REGISTRATION DATA:

In consideration for using Sarnam.com astrology, you agree to provide current, complete, and accurate registration information only about You only. Sarnam shall bear no responsibility if the information provided by You pertains to a third party.

During the currency of this Terms and Conditions, as herein contain, Sarnam reserves the right to make modifications/ alterations/ changes of the registrants profile. You shall intimate Sarnam with 7 days of advance notice in writing of any change in the Place/ Location as given in the registration details.

Liability Disclaimer:

Any prediction or other message that you receive is not a substitute for advice, programs, or treatment that you would normally receive from a licensed professional such as a lawyer, doctor, psychiatrist, or financial advisor. Sarnam.com provides no guarantees, implied warranties, or assurances of any kind, and will not be responsible for any interpretation made or used by the recipient of the information and data mentioned above.

Disclaimer of Warranties:

Sarnam.com on behalf of itself and its suppliers, disclaims all warranties of any kind, express or implied, including without limitation any warranty of merchantability, fitness for a particular purpose, title, or non-infringement and it makes no warranty or representation regarding the results that may be obtained from the use of content or services, the accuracy or reliability of any content obtained through the services. Sarnam.com makes no warranty that the services will meet your requirements, be uninterrupted, timely, secure or error free. No advice or information, whether oral or written, obtained by member from Sarnam.com or through the services shall create any warranty. Some jurisdictions do not allow the exclusion of certain warranties, so some or all of the above exclusions may not apply to you.

Limitation of Liability:

In no event shall Sarnam.com, be liable for any direct, indirect, incidental, punitive, or consequential damages of any kind whatsoever with respect to the service.

INDEMNIFICATION:

You agree to indemnify, defend, and hold harmless Sarnam.com, Sarnam. and subsidiaries, affiliates, officers, directors, employees, suppliers, consultants, agents from any and all third party claims, actions, liability, damages and/or costs (including, but not limited to, attorneys fees) arising from Your use of the Services, Your violation of the Privacy Policy or these Terms of Service, or infringement by You or any other user of Your account of any intellectual property or other right of any person or entity. These Terms of Service will inure to the benefit of Sarnam.com's successors, assigns, and licensees.

Sarnam.com reserves the right, in its sole discretion and without any obligation, to make any improvements/ changes/ alterations/ modifications to correct any error or omission in any portion of the content, or also to take down or delete any content for any reason at any time.

Miscellaneous:

This agreement is governed by the laws of republic of India. You hereby irrevocably consent to the exclusive jurisdiction and venue of courts in Delhi, India in all disputes arising out of or relating to the use of the Sarnam.com astrology products/other products and services. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Sarnam.com's failure to act with respect to a breach by you or others does not waive its right to act with respect to subsequent or similar breaches. This Agreement sets forth the entire understanding and agreement between you and Sarnam.com

Terms:

This Agreement shall continue in full force and effect for so long as you are using the Services. Either you or Sarnam.com may terminate the service at any time, with or without cause.

If Sarnam.com finds any information that the profile provided that is untrue, inaccurate, not current or incomplete, Sarnam reserves the right to suspend or terminate such account and refuse any and all current and future use of the services.

The Visitors are guided by the Privacay Policy laid down by the company

Liability & Indemnification:

Users of Sarnam.com expressly agrees that the use of this service is at User's sole risk. Neither Sarnam.com nor it's employees / associates make any warranty to the results that my be obtained from the use of Sarnam.com or as to the accuracy, reliability and content of any information, service or merchandise provide through Sarnam.com.

User expressly understand and agree that www.Sarnam.com shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Sarnam.com has been advised of the possibility of such damages), resulting from:

(i) The use or the inability to use the service;
(ii) The cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; (iii) Unauthorized access to or alteration of user transmissions or data;
(iv) Statements or conduct of any third party on the service; or
(v) Any other matter relating to the service.

User agrees to defend, indemnify and hold Sarnam.com and it's directors / employees / associates / affiliates not responsible from and against all disputes and expenses thereof, arising out of the use of by Sarnam.com user.

International:

User agree to comply with all applicable laws and governing rules of residing country, regarding transmission of any data and dealing with content online.If any service/product is banned in any country,then customers are requested to see their residing country laws related to a particular servicess/products.Because sarnam.com follows rules as per Indian Govt.Many products/services are not allowed in many other countries but allowed in india,and so customers must take care of this on his/her own.We will in no way responsible if any banned items/services(in that country)is ordered and shipped,in this type of cases,customers who ordered the banned product/services himself/herself will only be responsible.

Ownership and Liability:

Sarnam.com does not claim ownership of content that a user place on this site. By submitting content to Sarnam.com for inclusion on the site, the user expressly acknowledge that Sarnam.com does not pre-screen the content, but shall have the right but not the obligation in its sole discretion to refuse to post or remove any content that violates the TOS or is otherwise objectionable,or for any other reason which it feels is not in it's interests. User agree that user must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content.

Resale:

User agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service.

Termination:

User agree that Sarnam.com, in its sole discretion, may terminate user's profile / account, use of the Services and remove and discard any Content within the Service, for any reason, including, without limitation, for lack of use or if Sarnam.com believes that the user has violated or acted inconsistently with the letter or spirit of the TOS. Sarnam.com may also in its sole discretion and at any time discontinue providing the Service, or any part thereof, with or without notice. User agree that any termination of user access to the Service under any provision of this TOS may be effected without prior notice, and acknowledge and agree that Sarnam.com may immediately deactivate or delete user's profile / account and all related information and files and/or bar any further access to such files or the Service. Further, user agree that Sarnam.com shall not be liable to you or any third-party for any termination of your access to the Service.

Advertisements and Promotions:

Sarnam.com runs advertisements and promotions on the Site. Users' correspondence or business dealings with, or participation in promotions of, advertisers found on or through the Service, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between the user and such advertiser. User agree that Sarnam.com shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the Service.

The Service may provide, or third parties may provide, links to other World Wide Web sites or resources. Because Sarnam.com has no control over such sites and resources, user acknowledge and agree that Sarnam.com is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products, or other materials on or available from such sites or resources. User further acknowledge and agree that Sarnam.com shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource.

Proprietary Rights:

User acknowledge and agree that the Service and any necessary software used in connection with the Service ("Software") contain proprietary and confidential information that is protected by applicable intellectual property and other laws. User further acknowledge and agree that Content contained in sponsor advertisements or information presented to user through the Service or advertisers is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. Except as expressly authorized by Sarnam.com or advertisers, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the Service or the Software, in whole or in part.

Sarnam.com grants the user a personal, non-transferable and non-exclusive right and license to use the object code of its Software on a single computer; provided that user do not (and do not allow any third party to) copy, modify, create a derivative work of, reverse engineer, reverse assemble or otherwise attempt to discover any source code, sell, assign, sublicense, grant a security interest in or otherwise transfer any right in the Software. user agree not to modify the Software in any manner or form, or to use modified versions of the Software, including (without limitation) for the purpose of obtaining unauthorized access to the Service. USER EXPRESSLY UNDERSTAND AND AGREE THAT:

(b) Sarnam.com makes no warranty that (i) The service will meet user requirements, (ii) The service will be uninterrupted, timely, secure, or error-free, (iii) The results that may be obtained from the use of the service will be accurate or reliable, (iv) The quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations, and (v) Any errors in the software will be corrected.

(c) Any material downloaded or otherwise obtained through the use of the service is done at users own discretion and risk and that user will be solely responsible for any damage to his/her computer system or loss of data that results from the download of any such material.

(d) No advice or information, whether oral or written, obtained by user from Sarnam.com or through or from the service shall create any warranty not expressly stated in the tos.

EXCLUSIONS AND LIMITATIONS:

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. accordingly, some of the above limitations may not apply to you.

NOTICE:

Notices to user may be made via email. The Service may also provide notices of changes to the TOS or other matters by displaying notices or links to notices to user generally on the Service.

GENERAL INFORMATION:

The TOS constitute the entire agreement between user and govern the use of the Service, superceding any prior agreements between user and Sarnam.com (including, but not limited to, any prior versions of the TOS). User also may be subject to additional terms and conditions that may apply when the user use affiliate or other Sarnam.com, third-party content or third-party software. The TOS and the relationship between user and Sarnam.com shall be governed by the laws of India without regard to its conflict of law provisions. User and Sarnam.com agree to submit to the personal and exclusive jurisdiction of the courts located within the county of India. The failure of Sarnam.com to exercise or enforce any right or provision of the TOS shall not constitute a waiver of such right or provision. If any provision of the TOS is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the TOS remain in full force and effect. User agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the TOS must be filed within one (1) year after such claim or cause of action arose or be forever barred. The section titles in the TOS are for convenience only and have no legal or contractual effect.
